TERMS AND CONDITIONS OF USE

These Terms and Conditions (hereinafter, the “Terms”) govern your access to and use of the website. https://drfranciscohernandez.com (the “Site”), operated by the Dr. Francisco Rafael Hernández Pérez (hereinafter, the “Registrant”). By browsing, using forms, scheduling appointments or contacting by WhatsApp/phone/email through this Site, you accept these Terms in full. If you do not agree to them, please do not use the Site.
1) Purpose of the Site
The Site is strictly for informational and logistical contact purposes only:
a) To provide general information on orthopedic, traumatology and joint surgery treatments.
b) Facilitate digital channels (form, WhatsApp, call, mail) to request a face-to-face appointment, assessment or operational information about our services.
The content of the Site is in no way a substitute for a formal face-to-face or virtual medical consultation.
2) Medical Liability Waiver (No On-Line Diagnosis)
All information contained in the Site is of a general, educational and orientative nature. It does not constitute a diagnosis, surgical indication, treatment, or personalized medical recommendation, and does not create a doctor-patient relationship by the simple fact of browsing the page or sending a message.
The doctor-patient relationship is established only and exclusively when there is a formal clinical assessment accepted by the treating physician (Dr. Francisco Hernández) by opening the patient's clinical file.
3) Medical Emergencies
The Site and its digital contact channels (including WhatsApp) are not 24/7 emergency care services. If you present with a life or limb-threatening emergency (e.g. exposed fractures, bleeding, severe trauma), go immediately to the nearest hospital emergency department or call local emergency services (911).
4) Eligibility and Permitted Use
By using the Site, you agree to:
Use the contact channels providing truthful, current and lawful information.
Do not use the Site for fraudulent purposes, sending spam, or saturation of our hotlines.
Unauthorized automated use (bots), impersonation, or submission of defamatory, illegal or malicious content is strictly prohibited.
5) Scheduling, Cancellations and Availability
5.1 Appointment request
Sending a message via WhatsApp or form does not automatically guarantee the reservation of your appointment. The appointment will be considered confirmed only when our operational team expressly assigns and confirms the date, time and location (Hospital Punta Mita).
5.2 Change, Cancellation and Delay Policy
To ensure the quality of care for all our patients, we have established the following guidelines:
Cancellation or Reprogramming: At least one month's notice must be given. 24 hours in advance to your scheduled appointment by contacting our official WhatsApp or reception phone number.
Delay Tolerance: There is a maximum tolerance margin of 15 minutes about the time of your appointment. After this time, the appointment may be cancelled or rescheduled so as not to affect subsequent patients.
Fees and Penalties: The Contractor reserves the right to request an advance or full payment of the consultation fee for recurrent “No-Show” patients (no-shows).
6) Services, Costs and Billing
Prices, surgery costs or fee estimates are not officially published on the Site, as the total budget strictly depends on the individual clinical assessment, surgical complexity, type of implant and infrastructure costs of Hospital Punta Mita.
If you have Major Medical Insurance, it is your responsibility to verify the conditions of your policy. The Cardholder's team will provide the medical documentation (reports) required for reimbursement or direct scheduling, but does not guarantee approval by your insurer.
7) Telemedicine / Virtual Consultation
If a virtual consultation is arranged (especially for international or foreign patients):
The scope of the virtual assessment is limited to orientation, second opinion and review of previously submitted studies.
Due to its remote nature, the physician may imperatively require a physical face-to-face evaluation before issuing a definitive diagnosis or surgical plan.
8) Intellectual Property
The entire content of the Site (texts, structural design, logos, clinical writing, images) is the property of the Owner or is used under license. Copying, reproduction, distribution or commercial exploitation without prior written authorization is strictly prohibited.
9) Third Party Links and Platforms
The Site integrates links and third party tools (WhatsApp, Google Maps, analytics platforms). The Holder assumes no responsibility for the privacy policies, technical failures or data handling practices of such external platforms, the user being governed by the terms of each provider.
10) Privacy and Personal Data Processing

11) Limitation of Liability
To the maximum extent permitted by applicable law, the Holder shall not be liable for:
Direct or indirect damages resulting from the use, inability to use or technical failure of the Site.
Health decisions made unilaterally by the user based solely on the reading of the general informative contents of the Site.
12) Modifications to the Terms
The Holder reserves the right to modify or update these Terms at any time. The current version will always be posted on this page indicating the date of last update. Your continued use of the Site following any such modification constitutes your acceptance of the new Terms.
13) Applicable Legislation and Jurisdiction
For the interpretation, compliance and enforcement of these Terms, as well as for the resolution of any controversy arising from the use of the Site, the parties expressly submit to the federal laws of the United Mexican States and to the jurisdiction of the competent courts in the state of Nayarit, Mexico, The parties waive any other jurisdiction that may correspond to them by reason of their present or future domiciles.
